UPOV 의무 이행을 위한 품종②보호③ 제도는 처음에 「종자산업법」(법률 제5024호, 1995. 12. 6. 공포, 1997. 12. 31. 시행)에 편입되었다가, 절차·실체 규정이 단일법에 혼재된 문제를 해소하기 위해 품종②보호③ 관련 규정을 분리하여 「식물신품종① 보호③법」(법률 제11457호, 2012. 6. 1. 공포, 2013. 6. 1. 시행)으로 별도 제정되었다. 동법 제1조는 "식물의 신품종②에 대한 육성자의 권리 보호③"를 목적으로 명시하며, 제16조부터 제20조까지 UPOV 1991년 협약의 핵심 요건인 신규성(제17조)·구별성(제18조)·균일성(제19조)·안정성(제20조)(DUS)을 규정하고, 제56조는 품종②보호③권자에게 보호③품종②을 업으로서 실시할 배타적 권리(품종②보호③권)를 부여한다. 주무 기관은 농림축산식품부장관(수산 관련 품종②은 해양수산부장관)이며, 출원·심사·등록 업무는 국립종자원이 수행한다. 현행 법률은 법률 제21065호(2025. 10. 1.)까지 개정되었다.
