UN Convention Against Torture → Korea

The UN Convention against Torture^③ and Other Cruel, Inhuman or Degrading Treatment^② or Punishment (CAT^⑥) was adopted by the UN General Assembly on 10 December 1984 and entered into force on 26 June 1987. Article 2 requires each State party to take effective legislative, administrative and judicial measures to prevent acts of torture^① in any territory under its jurisdiction, and Article 4 obliges States to ensure that all acts of torture — including attempt, complicity and participation — are offences under domestic criminal law, punishable by appropriate penalties reflecting their grave nature. The 2002 Optional Protocol (OPCAT) additionally requires States parties to establish a national preventive mechanism (NPM) conducting regular visits to places of detention; South Korea has NOT ratified or signed OPCAT and has designated no NPM.

대한민국은 고문방지협약^④(CAT^⑥)에 1994.12.15 국회 비준동의를 거쳐 1995.1.9 가입서를 기탁, 1995.2.8 발효(조약 제1272호)함으로써 당사국이 되었다. 국내 이행은 별도의 단일 고문^①처벌법이 아니라 ① 헌법 제12조 제2항("모든 국민은 고문을 받지 아니하며…"), ② 형법 제125조(폭행·가혹행위^②) — 재판·검찰·경찰 등 인신구속 직무수행자 또는 보조자가 형사피의자 등에 대해 폭행·가혹행위를 한 경우 5년 이하의 징역과 10년 이하의 자격정지(실무 죄명 '독직폭행죄'·'독직가혹행위죄'; 특정범죄가중처벌법으로 상해·사망 시 가중), ③ 형의 집행^③ 및 수용자의 처우에 관한 법률(법률 제8728호, 2007.12.21 공포, 2008.12.22 시행; 소관 법무부)을 통해 분산 규정된다. 다만 대한민국은 고문방지협약 선택의정서(OPCAT)에 서명·비준하지 않았고, 국가예방기구(NPM)를 두지 않았으며, 국가인권위원회의 결정은 법적 구속력 없는 권고에 그친다. 또한 CAT 제1조에 부합하는 독립된 '고문죄^⑤' 구성요건은 입법되어 있지 않아 유엔 고문방지위원회가 반복적으로 시정을 권고해 왔다.
