대한민국은 부다페스트 사이버범죄③협약 가입을 위한 이행입법으로 「형사소송법①」을 개정하였다. 법무부는 2022년 10월 유럽평의회에 가입의향서를 제출하고 2023년 2월 가입 초청을 받았다. 전자증거② 보전요청 제도(전자증거②의 멸실·변경 방지를 위한 제도)를 신설하는 형사소송법① 일부개정법률안(대안, 의안번호 제2215141호)은 2025년 12월 12일 국회 본회의를 통과하였고, 2025년 12월 30일 법률 제21241호로 공포되었다. 신설된 제215조의2(정보통신서비스 제공자에 대한 보전요청 등)는 검사가 직권 또는 사법경찰관의 신청에 따라 정보통신서비스 제공자에게 전자증거②의 보전을 요청할 수 있도록 하며, 요청을 받은 제공자는 즉시 보전조치를 취한 뒤 그 결과를 통보하도록 한다. 보전기간은 60일 범위 내이며, 상당한 이유가 있는 경우 법원의 허가를 받아 30일 범위에서 한 차례 연장할 수 있다. 사법경찰관은 증거 멸실 우려 등 시간적 여유가 없는 경우 직권으로 요청할 수 있으나 즉시 검사의 승인을 받아야 한다. 이는 협약 제16조(저장된 컴퓨터 데이터의 신속한 보전)를 국내법으로 옮긴 것으로, 소관 부처는 법무부이다.
